Orange Villas Gandia Estate Agents recommend that property purchasers utilise the services of an english speaking spanish solicitor. They will inform you about the steps to be taken and the required documentation.
For Example:
The property register is a public, official file where all the deeds and contracts of the property and other real estate rights are recorded. The property register identifies the current owner and if there is a mortgage on the property or any court orders, purchase options or other rights over the property.
Check if there are any future building plans waiting for approval in the public consultation or execution phase, that may affect the property you intend purchasing or the surrounding area.
The deposit is an amount of money paid for a purchase option for the property you wish to buy. This is a contract from which both interested parties can withdraw within an agreed time frame. However, if the buyer withdraws they will loose their deposit - BUT - If the seller withdraws they will have to pay back twice the deposit paid by the buyers.
The next step is the purchase contract. This is a document clearly describing the property, by which the sellers are obliged to sell the property and the buyers are obliged to pay an agreed price for the property.
The formal act of selling/buying is documented by means of a contract signed in the presence of a Notary Public.
This is known as the Public deed.
Having settled the related fees and taxes this deed is taken to the property register.
The deed clearly specifies: the situation, property area, features, boundaries, price etc...
Your solicitor will present the documents before the Notary Public, to pay the related taxes and fees and take the necessary steps. Thereby, ensuring that everything is done in a correct and timely way from a legal point of view.
Once the fees are settled and the title deed is recorded in the properties register the original deed will be given to the new owner of the property.
